1. Acceptance of Terms

Welcome to Soul Fire Productions. These Terms of Service ("Terms") govern your use of our website and entertainment services. By accessing our website or booking our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Services

Soul Fire Productions provides professional entertainment services including:

• Fire dancing and fire knife performances
• Aerial acrobatics (silks, hoops, trapeze)
• Hawaiian and cultural entertainment
• Live music and DJ services
• Event planning and coordination
• Custom entertainment packages
• Photography and videography services
• Event decor and setup

All services are provided subject to availability and in accordance with these Terms.

3. Booking and Payment Terms

3.1 Booking Process

• All bookings must be confirmed in writing
• A signed contract and deposit are required to secure your date
• Bookings are subject to performer availability
• We recommend booking at least 4-6 weeks in advance

3.2 Payment Terms

• A 50% deposit is required upon booking confirmation
• Final payment is due 7 days before the event date
• Payments can be made via check, credit card, or bank transfer
• Late payments may result in event cancellation
• Additional charges may apply for services requested day-of-event

3.3 Pricing

All prices are quoted in US dollars and are subject to change. Prices may vary based on event location, duration, number of performers, and specific requirements. Travel fees may apply for events outside our standard service area.

4. Cancellation and Refund Policy

4.1 Client Cancellation

• 60+ days before event: Full refund minus $100 processing fee
• 30-59 days before event: 50% refund of total contract value
• 14-29 days before event: 25% refund of total contract value
• Less than 14 days: No refund

4.2 Force Majeure

If performance is cancelled due to circumstances beyond our control (weather, natural disasters, government restrictions, illness, etc.), we will work with you to reschedule or provide a full refund.

4.3 Our Cancellation

If we must cancel due to performer illness or emergency, we will attempt to provide suitable replacement performers or offer a full refund.

5. Event Requirements and Responsibilities

5.1 Venue Requirements

• Adequate performance space as specified in contract
• Safe and level ground for performances
• Access to power outlets if required
• Appropriate lighting for evening performances
• Changing area for performers
• Clear access for equipment setup

5.2 Safety and Permits

• Client is responsible for obtaining necessary permits
• Fire safety clearance must be obtained for fire performances
• Client must inform us of any venue restrictions
• Adequate safety perimeter must be maintained
• Client must provide fire safety equipment if required by venue

5.3 Weather Contingency

Outdoor performances may be modified or cancelled due to weather conditions. We will work with you to provide alternative arrangements or covered performance areas.

6. Liability and Insurance

6.1 Our Liability

Soul Fire Productions carries professional liability insurance and takes every precaution to ensure safe performances. However, our liability is limited to the total contract value.

6.2 Client Responsibility

The client assumes responsibility for:

• Guest safety and crowd control
• Venue compliance with local regulations
• Any damages to venue property
• Adequate insurance coverage for the event
• Supervision of minors during performances

6.3 Indemnification

Client agrees to indemnify and hold harmless Soul Fire Productions from any claims arising from the event, except those directly caused by our negligence.

7. Intellectual Property

All content on our website, including but not limited to text, images, logos, and video content, is the property of Soul Fire Productions and is protected by copyright and trademark laws.

Clients may photograph and video our performances for personal use. Commercial use requires written permission. We retain the right to photograph and video our performances for marketing purposes unless otherwise agreed.

8. Code of Conduct

We expect all clients and guests to:

• Treat our performers with respect and professionalism
• Follow safety instructions and maintain appropriate distance
• Not interfere with equipment or performance areas
• Refrain from inappropriate behavior or harassment
• Respect our performers' boundaries and requests

We reserve the right to cease performance and leave the event if our performers feel unsafe or disrespected.

9. Event Modifications

Changes to contracted services may be requested but are subject to:

• Performer availability
• Venue restrictions
• Additional costs
• Minimum 48-hour notice (when possible)

Significant changes may require a new contract and additional deposits.

10. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Hawaii. Any disputes will be resolved in the courts of Hawaii. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
